BEN’S BEGINNERS® Let’s Get Kids Cooking Contest
OFFICIAL RULES & REGULATIONS

This Contest is intended for viewing and participation in Canada only and shall be construed and evaluated according to the laws of Canada. Please do not proceed if you are not a legal resident of Canada at time of entry. Void elsewhere and where prohibited.

A valid e-mail address is required to participate in the Contest. Many public libraries, retail businesses and others offer free computer and Internet access and a number of Internet service providers and other companies offer free email addresses.

These Official Rules & Regulations (“Official Rules”) apply to the BEN’S BEGINNERS® Contest. By entering the Contest, you accept and agree to be bound by these Official Rules. If you do not accept them, you are not eligible to participate in the Contest.

The purpose of this Contest is to promote parents cooking with their children as a means of teaching them healthier eating habits for life. Cooking with your children makes for a great beginning.


1. CONTEST PERIOD:

The Contest commences on August 1, 2017, 2016 at 11:00 AM (ET), and closes on October 15, 2017


2. ELIGIBILITY:

The Contest is only open to legal residents of Canada who are the parent of legal guardian of a minor under the age of majority in his / her province of residence on the closing date, are resident and present in Canada at the time of entry, have a valid email address. Individuals who are a director, officer, or employee, of Mars Canada Inc. or its subsidiaries and associated companies, advertising and Contest agencies, the independent Contest Judges (collectively the “Contest Entities”), or persons who are domiciled or a member of the immediate family (defined as mother, father, brothers, sisters, sons, daughters and husband or wife) of any of the above persons, are NOT eligible to participate in the Contest.

3. HOW TO ENTER and SUBMISSION REQUIREMENTS:

NO PURCHASE NECESSARY: During the Contest Period, there will be a total of Five (5) recipes that will be published during the Contest Period (each recipe a “Participating Recipe”).

To enter the Contest, visit beginners.unclebens.ca (the “Contest Site”) during the Contest Period and then click the “Enter Now” button, then click on the "Join Now" button. Complete the online entry form by providing your first and last name, e-mail address, Age, Create a password, Confirm Password and click on the “Continue” button. Add your child's first name and your postal code, then confirm you are not a robot by selecting the requested images and click on the "Verify" button. Review the Official Rules and Regulations. If you agree, accept them as read and understood by clicking on the “Accept” checkbox. Upload a digital photograph directly or via Facebook or Instagram depicting a rice dish created with your child inspired by a Participating Recipe (there is no requirement to tag yourself or any other individual in the photograph), then click on the “Continue” button. Complete the photo submission by entering a title and caption for your image.



    The digital photograph must meet the following Submission Requirements:

  1. must not exceed a 10MB maximum file size;
  2. must be in one of the following formats: .JPG, PDF. .PNG, and .TIF and be of sufficient quality to enable posting on the UNCLE BEN’S® Canada Facebook page and/or the Contest Site, in Sponsor’s sole discretion;
  3. must be a unique photograph depicting a dish prepared by the Entrant with his/her child using rice as an ingredient (it is not necessary to include a product shot of an UNCLE BEN’S® product), and which has not been previously prepared by the Entrant for submission of an Entry to this Contest;
  4. must depict an accompanying parent or legal guardian (there is no requirement to depict or tag individuals in the photograph); if requested, Entrant must provide proof of parenthood/legal guardianship of the child in the photograph.

  5. In addition, the digital photograph, title and caption (collectively, “Content”) must meet the following Submission Requirements:


  6. must not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence (there is no requirement to depict or tag individuals in the Content);
  7. must be your own original creation and must not violate or infringe the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity, privacy or other proprietary rights;
  8. must never have been previously selected as a winner in any other contest, or previously submitted for entry in this Contest;
  9. must not be unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, contain explicit or graphic descriptions or accounts of sexual acts, or otherwise contain any content that is or can be considered to be inappropriate, unsuitable, objectionable or offensive, all as determined by the Sponsor in its sole and absolute discretion;
  10. must not victimize, harass, degrade, or intimidate an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
  11. must not contain any advertisement or solicitation not affiliated with the Sponsor;
  12. must not contain imagery, content, or any other element that is owned by a third party or that is associated with a competitive product to the UNCLE BEN’S® brand; and
  13. must in all other respects comply with the terms of these Official Rules.

  14. Before submitting your Content, you must confirm and agree to the following:


  15. that the Content is original and of your own creation;
  16. that your submitted photograph has never been previously selected as a winner in any other contest;
  17. that you have obtained all required consents to enter the Content in the Contest;
  18. that you consent to the Content being published on the UNCLE BENS.ca website, uploaded to the UNCLE BEN’S® Canada Facebook page and the Contest Site, and/or used to promote the Contest in regular media including broadcast media, for as long as the UNCEL BEN’S.ca , the Contest Site and/or UNCLE BEN’S® Canada Facebook page remain active, including after the end of the Contest Period;
  19. that you agree to the editing/modification/alteration/removal of the Content;
  20. that you agree to be named or not named as the owner/creator of the Content at the Sponsor’s sole discretion; and
  21. that the Content otherwise meets the Submission Requirements set out above.
When all required steps of the entry process are complete (including fully completing the entry form and uploading/providing your Content), follow the on-screen instructions and click on the "Submit" button to complete your entry (entry form and Content hereinafter collectively referred to as the “Entry”).

To be eligible, Entries must be received prior to the end of the Contest Period. Entries that are received after the end of the Contest Period will not be eligible.

All Entries submitted will be reviewed by Sponsor and/or its promotional agency within 72 hours to ensure that they qualify in accordance with the Official Rules, including the Submission Requirements outlined above. Sponsor reserves the right to disqualify any Entry that it determines in its sole and absolute discretion fails to meet the Submission Requirements or is otherwise not in compliance with the Official Rules. Entries may be disqualified if any of the Content is damaged, corrupt, incomplete, of poor quality, or otherwise deemed insufficient or unacceptable for public viewing, in the Sponsor’s sole discretion.

If the Sponsor and/or its promotional agency determines that a submitted Entry complies with these Official Rules (including the Submission Requirements outlined above), the Sponsor will post the Content on the Contest Site. If at any time during the Contest Period, the Sponsor determines that an Entrant’s Content fails to meet the Submission Requirements above or is otherwise not in compliance with these Official Rules, Sponsor may remove the Content from the Contest Site and disqualify the Entry.

Each Entry in the Contest, subject to the entry limit specified below, will receive one (1) entry into the Grand Prize sweepstakes.  

4. ENTRY LIMIT:

LIMIT OF ONE (1) ENTRY PER PARENT OR LEGAL GUARDIAN, PER CHILD, PER DAY for the duration of the contest. Any additional submissions exceeding the limit will be disqualified. . More than one child can be in a photograph submission . However, only one child and parent/ legal guardian will be eligble to be entered for each unique photograph submission. Entries may be entered by the same parent or legal guardian and email address during the Contest Period. For greater certainty and avoidance of doubt, the same parent or legal guardian can only use one (1) email address to enter the Contest, and may not enter the same photograph of recipe more than once.

Any additional Entries submitted will not be eligible or otherwise considered by the Sponsor. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) daily Entry per parent or legal guardian/email address, per child per; and/or (ii) use (or attempt to use) multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.

5.PRIZES AND ODDS OF WINNING:

There is a total of one (1) grand prize available to be won in the Contest. The Grand Prize consists of ten thousand Canadian dollars ($10,000.00 CAD) to be awarded in the form of a cheque issued to the Grand Prize winner in his/her name which may be used towards a Registered Education Savings Plan (RESP) for the winner’s child.

6.In no event will the Sponsor be liable for more than the number and value of Prize described above. Odds of winning are dependent on the total number of eligible Entries submitted during the Contest Period.

7. RANDOM DRAW:

One (1) potential Grand Prize winner will be chosen by random selection on October 30 2017

The Potential Grand Prize winner will be notified by email and/or telephone on or about October 30 2017. In order to win, the selected Entrant must correctly answer, unaided, a mathematical skill-testing question to be administered via telephone or email, and must otherwise comply with the Official Rules. Prior to being declared a winner, the selected Entrant will be required to execute and return additional prize acceptance documents (“Prize Acceptance Documents”) and/or liability waivers. If the selected Entrant fails to answer the skill-testing question correctly, Prize Acceptance Documents and/or liability waivers sent to the potential Grand Prize winner are not deliverable, or if the potential Grand Prize does not respond within the time period specified, refuses to accept the terms and conditions of being a Grand Prize winner, or is otherwise found to be ineligible or not in compliance with these Official Rules, the potential Grand Prize winner will be disqualified and another Entrant will be randomly selected as a potential Grand Prize winner.

8. GENERAL:

  1. 8.1. By entering the Contest, Entrants agree to abide and be bound by these Official Rules and decisions of Sponsor and Contest judges, which are final and binding on all Entrants with respect to all aspects of the Contest.

  2. 8.2. The Sponsor is not responsible for typographical errors or any other errors in the offer or administration of this Contest, whether human, mechanical, clerical, electronic, or technical in nature, including but not limited to errors in advertising materials and the Official Rules.

  3. 8.3. In the event of a conflict between Contest details contained in these Official Rules and Contest details contained in Contest advertising (including but not limited to online, point of sale, television, and print advertising, packaging, and other Contest media), the details of the Contest as set forth in these Official Rules shall prevail.

  4. 8.4. All Prizes must be accepted as awarded. Sponsor reserves the right to substitute a Prize(s) of equal or higher value at its sole discretion. Any portion of a Prize(s) that is unused or which is not used according to these Official Rules will be forfeited and will have no cash value.

  5. 8.5. All Entries become the property of Sponsor and will not be returned. By creating and submitting Content, you grant the Sponsor and its affiliates a worldwide, non-exclusive, sub-licensable (through multiple tiers), transferable, fully paid-up, royalty-free, perpetual, irrevocable right to use, reproduce, distribute (through multiple tiers), modify, enhance, create derivative works of, publicly perform, publicly display, digitally perform, make, have made, sell, offer for sale, export and import your Content (or your name and other Entry information, if applicable) in any media now known or hereafter developed for any purpose whatsoever, commercial or otherwise, without further approval by or payment to you. You agree to waive any moral rights in your Content for this purpose. However, nothing shall obligate Sponsor to publish or otherwise use your Content except at its sole and absolute discretion.

  6. 8.6. By entering the Contest, each Entrant agrees to the use of his/her name, address, photograph or other likeness, his/her child’s first name and photograph or other likeness, their recipe and Content, as well as his/her and his/her child’s appearance at publicity events, without any additional compensation and as required by the Sponsor if he/she is declared a winner. The winner will be required to sign a publicity release to this effect.

  7. 8.7. Sponsor accepts no responsibility for lost, stolen, deleted, delayed, late, damaged, corrupt, misdirected, incomplete, unrecorded, unplayable or illegible Entries, Prize Acceptance Documents and/or waivers, or any failure of the Contest Site or any related website during the Contest Period, or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant’s or any other person’s computer related to or resulting from entering the Contest or downloading any material relating to the Contest. Proof of transmission does not constitute proof of delivery.

  8. 8.8. The Sponsor reserves the right to disqualify any Entrant’s Entry in the Contest (and void all associated Entries) or entitlement to a Prize, if, in the sole discretion of the Sponsor, it is determined or suspected that the Entrant has attempted to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other fraudulent, deceptive or unfair practices (including any Entries generated by script, macro, robotic, programmed, or any other automated means).

  9. 8.9. In the event of a dispute as to the identity of an Entrant, Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person assigned to an e-mail address by an Internet service provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain. The potential winner may be required to show proof of being the authorized account holder for that e-mail address.

  10. 8.10. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. Any Entrant engaging in any of the foregoing activities may be disqualified and will forfeit any Prize won.

  11. 8.11. As a condition of entering, each Entrant agrees: (a) to release Sponsor and Contest Entities, and each of their officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to participation in the Contest or the awarding, receipt, possession, and/or use or misuse of any Prize , (b) that under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest, or any Prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.

  12. 8.12. The Sponsor reserves the right to suspend, cancel or modify the Contest at any time, subject to the approval of the Régie des alcools, des courses et des jeux in Quebec, for any reason, including fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor, that corrupt the administration, security, integrity or proper play of the Contest.

  13. 8.13. This Contest is exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder shall be adjudicated solely in the applicable court in Toronto, Ontario, Canada. Contest is subject to all applicable federal, provincial, municipal and local laws and regulations and is void where prohibited by law.

  14. 8.14. For Quebec residents: any litigation respecting the conduct or organization of a Publicity Contest may be submitted to the Régie des alcools des courses et des jeux for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

  15. 8.15. In the event of any discrepancies between the English language rules and the non-English language rules, the English rules shall prevail.

  16. 8.16. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In particular, Sponsor’s employees are not authorized to waive, modify or amend any provision or provisions of these Official Rules in any manner whatsoever.

  17. 8.17. By entering the Contest, Entrants consent to the collection and use of their personal information as per the privacy policy found under the heading “Privacy” on the UNCLE BEN’S ® brand website www.unclebens.ca. For a copy of the privacy policy visit http://www.mars.com/privacy/pp_english.asp. Sponsor will not sell, share or otherwise disclose personal information of Entrants or Registered Voters with third parties or agents, other than to third parties or agents engaged by Sponsor to fulfill the above purposes or as permitted or required by the applicable laws.
